The Sheriff Part Two
Yesterday I recounted the Bristol County Sheriff’s spending county funds on and then giving away a totally unnecessary and useless boat.
What follows are some other expenses beyond his budget that he has laid on the county that he now wants to impress with his support of Trump’s wall. While having its taxpayers pay for his scheme with funds and resources that should stay in the county, he intends to take the bows for being such a great American.
The sheriff of Bristol County seems to love law suits, and is even fond of recreating the circumstances that brought about a previous suit.
During his swearing-in speech in January the sheriff stated that he would once again institute his idea to charge inmates $5 a day while they are incarcerated at the Bristol County House of Correction in Dartmouth and the Ash Street Jail in New Bedford.
In 2010 the Massachusetts Supreme Judicial Court had struck down this practice in ruling that the sheriff did not have the legal authority to charge inmates that daily fee. He charged those fees for room and board, as well as for medical care and other services. He also charged a $5 “cost-of-care” fee, $5 medical appointments, $5 for an eyeglasses prescription, $3 per pharmaceutical prescription, $5 per haircut or beard trim. and $12.50 for GED testing
Considering that many people incarcerated in the county jail may be poor, this is an unnecessary financial burden placed on the families of the incarcerated who already pay for the jails through taxes.

Hodgson lost a case against him for triple-bunking inmates, using portable bunks or floor mattresses, and requiring some inmates to sleep in common areas at New Bedford’s Ash Street facility. He was housing inmates in “dry cells” that did not have toilets at the Dartmouth House of Correction.
It was determined that these practices violated the rights of inmates.
According to the lawyer for the inmates, every time a specific complaint was brought to the sheriff he would address it, but then he would start another violation in its place.
This case took 11 years to resolve, and that cost Bristol County taxpayers money.
In a ten year period, the sheriff spent $4.7 million on legal suits in Bristol County paid for with the money of Bristol County taxpayers.
During that time the sheriff paid $1.3 million to one Fall River law firm and an estimated $1.3 million to another there.

That lawyer was, by the way, cited by the Office of Campaign and Political Finance for making a $2,000 contribution to one of the sheriff’s campaigns which violated the $500 maximum.
In that same ten year period, the sheriff spent $1 million in bills for contracted lawyers from a Boston firm and another $1 million on in-house lawyers.
While spending money on losing legal cases, the sheriff failed to pay several million dollars in inmate medical bills because of alleged lack of funding. This lack of funding also resulted in not keeping an appropriate inventory, and the sheriff at one time alerting the governor that he might have to send in the National Guard to run the Bristol County House of Corrections.

Since 2006, the Bristol County jail has had 50% more suicides than Suffolk County and more than twice as many as Essex and Worcester Counties.
The Bristol County jail is at 300% of design capacity, and overcrowded jails can set the stage for suicide by increasing stress on inmates and correctional officers, yet the sheriff says that overcrowding is not the problem, but social problems like the opioid addiction crisis in the county is.
But because his jail doesn’t track it, he can’t possibly know how many of the recent inmates who have killed themselves were drug addicts.
The excuse sounds good, so he advances that instead of addressing the problem, even as he ignores official warnings from local courts about inmates at immediate risk of suicide.
In one case, even though the inmate told a court psychologist of his desire to kill himself, and the doctors, the lawyer, and the judge took it seriously, nothing was done. After a fight in the jail, that inmate was sent to a segregated unit, a solo cell used to discipline inmates, where inmates are under a 23 hour lock down and meals are slid under the door.
The inmate hanged himself.
There is one counselor to about 100 people. Other county jails have up to 10 Counselors for the number of prisoners Bristol County Jail has.
But Sheriff Hodgson believes the mental health program that costs the county $8.2 million is doing just fine.
Hodgson believes it’s hard to predict all suicides, so, I guess, why take the proper steps when someone says they are considering it,

Perhaps what needs fixing is the desire to make a name for himself at the county’s expense, and ending the hare brained actions that cause losing law suits or misspending available funds.
Sheriff Part One
When I move to a location, I want to learn as much as I can about where I live, and to do that I, get involved in my community, joining organizations, volunteering at local places, and reading as much as I can about where I am.
Sometimes something is thrown at me that was not in my wheel house and perhaps was totally unknown to me.
Such was the case when the Sheriff of Bristol County, someone with whom I had no dealings and being a law abiding citizen would have no need to get to know, announced at his 2017 swearing in that he would volunteer inmates from the county jail to build Trump’s Border Wall. I oppose the idea of a wall, and keep up with the news about it, but this volunteering inmates was something new, and so I began to familiarize myself with the sheriff to see just who he was.
He was proposing spending county funds and using county resources to step outside his role and gain national attention.
That is not his job, and local citizens of the county in the jail should be prepared to reenter their local community as contributing citizens, and not be used as indentured servants for something which has no direct positive effect on their home community.
I already knew that he was a Republican and obviously claimed to be so pro-America that he would do something like what he was announcing he would do, and that he promoted himself as a fiscal conservative intent on being a good steward of the county citizens’ tax dollar, although he seemed to be ignoring that transporting, housing, guarding, and feeding the wall-builders would cost county money.

Swansea, with whose police chief the sheriff had worked on a committee, approached him about giving the town the boat, and he saw it as a good idea that would be beneficial to one community in the county.

This piqued my interest, especially when reading through some other articles about the sheriff I came across this comment related to the sheriff’s claim of being a good, fiscally responsible Republican on a Republican website,

A good manager with fiscal conservatism is able to manage the budget and if forecasting a shortfall finds innovative ways to meet the goals of the organization (in this case: Care, Custody and Control)”
I just had to do more research. If his fellow Republicans were calling him out, perhaps he had a propensity for squandering county funds and resources, much as he was intending to do with his wall building scheme.

In all likelihood, I would never have noticed what it was like for them, unless I associated with them, and I might have assumed that the smallest slight for me was a huge persecution.
All that changed when I added one word to my description.

let me explain this to those who may question my involvement in rallies, demonstrations, and protests and assume I am an ally of everyone there.
Throughout my adult life from my early 20s to now in my 60s when I attended, and continue to attend a rally in support of something or a demonstration against, whether strictly political, or involved civil and Gay rights, union and labor rights, or for the dissemination of information, I never hide.

Lately at rallies and demonstrations I have noticed those people dressed like ninjas, all in black with their faces covered leaving only a slit large enough for them to see unless even that area is covered by sunglasses. Their identities are completely hidden.
Often they have been disruptive to the point of being physical.
Recently before one demonstration, the participants were given the standard instructions not to verbally react to anything yelled by an opposing group, nor get physical in any way. After the group had established its place at the site of the event, four or five “ninjas” suddenly appeared among us, and they went to the opposition’s side of the street and began grabbing signs and pushing anyone who resisted. They may or may not have agreed with our message, but their actions put us in a negative light. They either did not know the rules as given, simply decided to act on their own, or were from the opposite side and pretended to be one of us as a way to distract from our message and by their rudeness put us in a bad light.
I have to admit, I cannot agree with nor am I trustful of protesters who are so hidden that you have no idea who they are and cannot trust because you do not know if they are actually part of the group, or infiltrators whose purpose to undo or prevent any possible positive results by instigating violence whether verbal or physical.

New Bedford Part Two: A Ciceronian moment.
I do not want to start any rumor or get people involved in what could be an unnecessary defense posture, so I will not point out that in the early months of 1854 a Norfolk, Virginia newspaper reported that slaves had been escaping from that port city so regularly as to be a daily occurrence. The suspicion was that their escape was aided and abetted by the ships coming from and returning to New Bedford.
One slave owner, Major Hodsdon, was so perturbed by his loss of slaves that he traveled to Boston to retain a lawyer and to have the Massachusetts Attorney General write to Deputy Marhall Hathaway of New Bedford advising him to keep an eye out for any of Hodsdon’s property. The practice in New Bedford was to follow the 1843 state law, and, because of the city’s commitment to human equality, ignore the Fugitive Slave law.
The result was that the South began boycotting New Bedford merchants because they were instrumental in aiding and protecting fugitive slaves.
Although the South claims that the Civil War was fought in defense of states’ rights and not to end slavery, they opposed New Bedford’s supporting the Massachusetts state’s right over the federal law the South had brought about.
Now in 2017 the Bristol County sheriff is vehement in opposing any sanctuary for undocumented immigrants including those who have come here as fugitives from countries where they were facing oppression and death. But I am not saying that.
New Bedford Part one
The movement to make a place like New Bedford a Sanctuary City has been relying on having the city council enact an ordinance to that effect.
However, since from its founding by Quakers and then throughout most of the 19th Century the city of New Bedford was influenced by the beliefs and attitudes of that particular sect and unconsciously many of its beliefs have become embedded in the spirit of the city, I thought an alternate approach would be to research if in the 19th century, in the days before the abolition of slavery, the city of New Bedford had any law on the books supporting aid to fugitive slaves, or, as the practice was wide spread, any ordinance to stop it.
Before it was enacted, there was some wiggle room in New Bedford when it came to fugitive slaves, but with the passage of the Fugitive Slave Law that was lost. You were expected by Washington to either obey the federal law, or ignore it at your legal peril.
Or perhaps not.
Most galling about the passage of the law was the hypocrisy that while slaves were not people, when it came to determining representation in the House of Representatives, each slave was counted as 3/5 of a human and slaves were then counted accordingly in the population. In the North chattel was chattel 100% of the time. A cow was always a cow. But in the South, certain chattel were chattel when it was advantageous to be, but became people when that was advantageous.
As a result, the South always had a representational advantage in Washington, and passage of the Fugitive Slave Law was easy.
Prior to the law’s passage, New Bedford was one of the terminal cities of the Underground Rail Road, and it is estimated that prior to its passage there were about 400 fugitive slaves living in the city that had a total Black population of just over 1,000.
Many of the fugitive slaves were at one point housed in the homes of prominent citizens like Thomas Arnold and William Rotch.
By 1840, there was only on average two men of color on each whaling voyage, which meant the majority of the city’s black population worked where they lived on land and saw no need to further escape to the sea.
When the Fugitive Slave Law passed, many escaping slaves only used New Bedford as a stopping off point until passage to the towns established in Canada by escaped slaves could be arranged. And since any Black person could have been rounded up by Southern bounty hunters, those who did not feel safe also moved further north.
I found that during the time fugitive slaves were in New Bedford, even though their protection was an unlawful act there was no formal ordinance one way or the other that established a formal ignoring of the federal law, nor any ordinance against those who ignored it.
