I thought it was a rare event, and one, that upon others hearing of it, would not be repeated.

It happened in the 1980s, and as it was a while ago, a blip on my radar, and my life has been very involved and busy since, I can only recall the main details.

A teacher in a town in which I lived, endeavoring to reduce school yard injuries among her elementary school students, had bought a supply of Nerf Balls of various sizes so that in any game that called for students to throw a ball to or at each other, injuries could be avoided.

During recess one day, while she was involved in a game with some of her students, the teacher threw a Nerf Ball to a student who was slow to act, and the ball bounced off his forehead. Surprisingly the child fell to the ground and died a little while later.

As it turned out, the student had a small clot  in his brain just behind his forehead that just needed a small jostling to have it rupture, something that could be as simple as the kid swatting a mosquito on his forehead, or in this case having a Nerf Ball bounce off it.

There is no money to be had from an accidental death, so the family charged the teacher with the murder of their son because she had thrown the Nerf Ball that had ruptured the clot. It could have happened at any time, in any place, and because of any innocent action by any one, including the child himself, but the sequence here was clear. The teacher had thrown the Nerf Ball; it hit the kid’s forehead; the kid died because of it. So, the teacher was responsible.

Regardless of the final outcome and the fact that no one could have prevented the death because no one had been aware of the undetected condition as the child had never exhibited any evidence of the time bomb in his head so the need for prevention or protections was not known to exist may have reduced the charge, the initial shock of the death from an innocent act, and the psychological toll on the teacher when that was compounded by a legal proceedings had to be immense.

One can only imagine the toll on a child if it had been a child who threw the Nerf Ball and the parents had acted the same.

Some 10 year olds were recently playing Dodgeball during recess at school. Yes, Dodgeball, that game where each team throws balls at the other. That game anyone reading this has probably played with varying degrees of enjoyment. After the game one student was given a one-day suspension for allegedly hitting a classmate in the face with a ball during the game because the child reportedly sustained a concussion.

As odd as this was, being punished for doing something that is part of the game, things took a further turn into oddness when that kid’s mother received a phone call from the local juvenile court  months after the Dodgeball game explaining that her son would be charged with aggravated assault  because the concussed child’s mother said her son had a previous medical condition that made him susceptible to head injuries. She also complained that her son had sustained facial tissue damage to his face, a black eye, and a bruised nose.  And, she contended, seemingly ignoring that balls are thrown in Dodgeball on purpose, it was no accident.

The accusing mother also admitted that her son had already experienced similar incidents while engaging in physical activities at school.

She had taken no actions, made no recommendations as to what activities teachers should prevent her son from getting involved in, nor made any requests that would have ruled out any activities that might injure her son, but had “tried not to let it get to this point”.

If the parent was concerned about her child’s propensity for injury and if the student had a history of injuries, the child should have been told by his mother not to play any games that could cause injuries and the school should have been told not to allow him to. If the child disobeyed the parents or the school ignored any cautions, blame could be properly placed. But as it is, some kid is being forced to bear the blame.

There are two victims here.

One is the kid who now faces a court hearing, the resulting publicity and unwanted attention, some type of punishment, and a negative reputation with peers and his school that could haunt him during his school years and after that could erase the person he could have been in favor of the person this makes him become.

The other is a kid who will spend his school years known as the kid who needs his parents to protect him, and with whom they can’t play because his parents might go after them if he gets hurt.

The kid shouldn’t have been playing a risky game in the first place.

If a child has a medical condition and as the parent fail to alert the school and teachers about it, then it’s their fault if something happens, not some kid who was just playing a game as it is supposed to be played.

And there may be  more to the story.

Aggravated assault seems to be a little too harsh a charge, but that is what the Wayne County Michigan’s Juvenile Prosecuting Unit went with according to assistant prosecuting attorney Maria Miller.

A detail that cannot be overlooked, especially because of the nature of the game and that this is not the only time some kid got hit in the face during a game of Dodgeball, is that a White kid was hit by a ball thrown by a Black Kid.

In my years of teaching in different public schools in three states, I, and other teachers, saw a certain obvious degree of inequality in the severity of punishment given between students of color and the white students for the same offense, but were usually ignored when we pointed this out to administrators.

But now a 2018 report by the watchdog Government Accountability Group found this to be true. Black students in grades K-12 are far more likely to be disciplined at school from suspension to referral to law enforcement than kids of other races, and a Brookings Institution study confirmed this and it was not limited to those states known for racial disparity.

“Why is so much money sent to the Elijah Cummings’ district when it is considered the worst run and most dangerous anywhere in the United States? No human being would want to live there. Where is all this money going? How much is stolen? Investigate this corrupt mess immediately!”

Cummings’s district is about 55% black and includes a large portion of Baltimore, but also includes Howard County which is frequently cited for its affluence, quality of life, and excellent schools, includes many of the most affluent communities in the Baltimore-Washington Metropolitan Area, and has been rated among “America’s Best Places to Live” and Baltimore county which is home to multiple universities and suburban and rural areas.

So, let’s pause and think.

Cummings, a Black man, represents a population that is 55% Black in a district containing universities and affluent communities that is not on the poorest or government dependent lists, but, rather one of “America’s Best Places to Live”, but is, according to Trump, the  worst run and most dangerous district anywhere in the United States where no human being would want to live.

But the 10 worst cities in the 10 worst counties in the 10 poorest states are doing just fine.

I wonder what the basis of Trump’s judgment is.

Perhaps his claim that Baltimore is a vermin-infested city is based on his confusion with Mar A Lago that has had health department violations and sanctions for rust, mold and parasites, resulting in 78 health violations in the last three years.

Or, perhaps, he generalized that his son-in-law’s family company that has owned almost 9,000 rental units across 17 complexes in Baltimore County was responsible for more than 200 code violations, all accrued in the span of one calendar year, with some being addressed because of threatened fines, while other violations on nine properties were not, applied to all of Baltimore, both the city and the county.

Kushner Companies, and its affiliated entities, has charged tenants excessive fees and with the threat of eviction to pressure them to pay up, and has requested the civil arrest of 105 former tenants who didn’t.

Pressed further, as his answer implied that there was the possibility that “criminal or national security threat” could be supported after examination, he was asked,

“Do you know any 3-year-olds that are criminal or national security threats to the United States?”

Chief of Law Enforcement Operations for Customs and Border Protection Brian S. Hastings  admitted,

“No, I don’t.”

In spite of that, the three year old was separated from her grandmother for 47 days, and was only reunited after the Trump administration was forced to reunite them by court order.

Any defense of the separation being based on the grandmother’s being a “criminal or national security threat” was very much weakened when  Chief of Law Enforcement Operations for Customs and Border Protection Brian S. Hastings admitted that in that regard,

 “I don’t know—again, I don’t know the background of what her grandmother or relatives were.”

The testimony showed that the family separation policy of the Trump administration is arbitrary and baseless, and the assumption that those coming to the border were bringing drugs, bringing crime, were rapists , and not the right people was weak justification at best.

The fact that it took a court order to reunite the child with her family and that the administration had not come up with a plan to reunite families in spite of the separation policy resulting from, I assume, some degree of planning and was not a spontaneous action, would seem to indicate that the Trump administration intended for family separation to be permanent.

So you would do the deportation before the reunification without any knowledge of whether the parents are being reunified?”,

Hastings replied,

“Yes.”

I have had conversations with people who like to say that all those people arriving at the Southern Border should enter legally like their family had done, but it is obvious that they really do not know what entering legally means since they do not realize, or chose not to accept, that the vast majority of those at the border are doing just that.

The Mueller report has been submitted, the redacted version has been made available to the public, and Robert Mueller has testified before the Judiciary and Intelligence committees answering questions whose answers were not in the report, debunking the “no collusion/completely exonerated” mantra.

So the GOP has pronounced that it is time to hang it all up and move on. Just as it is known to do when it is in the position to investigate.

The Republican House Oversight Committee questioned Clinton following the Benghazi attack, and released a report on the Accountability Review Board appointed by Clinton to review the attack. It criticized the conclusions in the board’s final report.

This was followed by a December report from the Senate Committee On Homeland Security And Governmental Affairs detailing the “high risk” of a terrorist attack at the U.S. facilities in Libya. The report criticized the State Department for not addressing the security concerns leading up to the attack and administration officials for being inconsistent in stating publicly that the deaths in Benghazi were the result of a terrorist attack.

This was followed by a Senate Select Committee on Intelligence in January 2014 calling the Benghazi attacks “preventable.” Although it found the administration failed to adequately increase security in the weeks leading up to the attack, it ignored that some of the people reaching this conclusion had previously voted to cut security funding.

On January 23, 2013 Clinton testified for close to six hours before this House committee on Foreign Affairs and the Senate Foreign Relations Committee. The House Committee criticized Clinton and other high-ranking officials saying they had been  “provided extensive warning of the deteriorating security environment in eastern Libya”, and criticized the State Department’s Accountability Review Board for failing to comment on the actions of the department’s highest ranking officials, including Hillary Clinton.

The House Committee on the Judiciary then investigated the FBI investigation that followed the attack at Benghazi charging it with not investigating the scene until three weeks after the attack and spending less than one day collecting evidence in Benghazi, and Clinton for reducing security at the Benghazi consulate in spite of the testimony that she “had no knowledge” of security requests.

The Republican led Armed Services Committee began its investigation immediately after the terrorist attack in Benghazi, Libya and reported that the Obama administration failed to address security threats in Benghazi,

The House Intelligence Committee exonerated the Obama administration of wrongdoing in its response to the attack. The committee had found evidence of contradicting intelligence among government officials and concluded officials did not intentionally mislead the public in the days following the attack.

Then the Republican-led House created the House Select Committee on Benghazi because a conservative watchdog group had discovered new State Department emails about the attacks, and Clinton faced more scrutiny over Benghazi after it was discovered she used a private email server while serving as Secretary of State. This resulted in a yearlong investigation into Hillary Clinton’s use of private emails for official business while she was Secretary of State, an investigation that concluded with the FBI  not recommending prosecution to the Justice Department because,

“Although there is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a case.”

It as also concluded that Clinton’s actions were largely consistent with previous secretaries of state.

The end result was that in spite of their negative conclusions none of the committees, the House Committees on Oversight and Government Reform, Judiciary, Foreign Affairs, Armed Services and Intelligence Committees, found what they were hoping to find, but the GOP kept trying.

The FBI probe cost the taxpayers $20 million.

The cost of the repeated Benghazi investigations which, when they found nothing with which to charge Hillary, produced follow up investigations to try again, was close to $30 million.

And all this, as many Republicans had admitted the investigations were an attempt to wound Hillary Clinton’s feared 2016 Presidential run.

Concerning the Benghazi hearing, then House Majority Leader Kevin McCarthy, who was hoping to be the Speaker of the House after the 2016 elections asserted,

Now for the House Minority Leader, Kevin McCarthy, who supported all the Benghazi hearings to weaken Clinton at great expense but no return, one investigation is enough and the misrepresentation of the findings sufficient, has decided,

“As we officially close this chapter, it is important for us to learn from the moment. As we look back, Democrat leaders acted irresponsibly and threw caution to the wind to damage and distract from the work the Trump administration is doing on behalf of our fellow citizens. While this conclusion is an embarrassment to those Democrats, it is more discouraging to think of the opportunity costs to our country.

This should be a lesson to my Democrat colleagues that chasing imagined scandals and following a partisan investigatory agenda will not result in any meaningful change for the country. In fact, it will do the opposite. I understand that Democrats today are struggling with their own deep divisions and that it might be easier to attack President Trump than work together for a common cause. But after months upon months of manufactured outrage on this issue, it is time we move on for the good of the nation and focus on the job we were sent to Washington to do: work to address the real challenges facing our country.”

Punishment, not reward, for trying

Undersecretary Brandon Lipps, USDA Acting Deputy, announced the agency’s proposed elimination of the policy “Broad-based Categorical Eligibility” (BBCE) in order to save $2.5 billion.

The BBCE system has been around for 20 years with broad bipartisan support, until recently.

Eliminating BBCE would result in three million people losing food stamps including more than a quarter of a million children who are receiving free school meals, although they would be eligible for the reduced-price meal options.

Not only would this remove three million poor people from the food stamps system, but it would also require state program administrators to revert to old systems that pile up additional paperwork, staff hours, and costs.

Presently states can choose to expand access to the Supplemental Nutrition Assistance Program (SNAP) beyond the scope built into federal anti-hunger legislation, and twenty-eight states, the District of Columbia, and the territorial governments of Guam and the Virgin Islands have been making modest expansion of income limits BBCE allows.

Also eliminated would be the 20-year-old rule’s allowance for states to suspend the “asset tests” in federal law that denies SNAP to any recipient who manages to accumulate roughly $2,000 in personal savings as more than 40 jurisdictions have done. Three-quarters of the households receiving SNAP  in those twenty-eight states, the District of Columbia, and the territorial governments of Guam and the Virgin Islands have less than $500 in liquid assets.

This could result in low-income workers not working more or taking a job with better pay, because if they reach the $2,000 limit it could eliminate needed assistance, making working-poor Americans less independent.

After years of bipartisan support, conservatives have recently begun to oppose both BBCE and the food stamp program in general.

I attended an elementary school run by nuns, the Sisters of St. Joseph in the 1950s.
