Why kids don’t know civics

Back when Justice Scalia died and President Obama had the opportunity to nominate a replacement Supreme Court justice, the GOP in the senate declared that they would not consider any replacement presented by the president, but, rather, would wait until the next president was elected claiming they could only act in accordance with the will of the people, as if the people who elected and reelected Obama had not expressed their will.

Of course, that was back when there was a whole team of potential GOP presidential candidates as it was the primary season, and the thought at the time was that, as crazy as the potential candidates were, there had to be at least one reasonable one they could count on to make a good choice.

The GOP justification was that a president appointing a Supreme Court justice in his last year could actually appoint one who could just be a pain in the butt and simply a nasty last act. So they stressed the not-in-the-last-year thing as if a president is only elected for three, not four, years.

We have seen what happened next, so Senator McConnell suggested that perhaps, just perhaps, the senate would entertain a nominee after the election and before the inauguration.

This change of heart revealed that the reluctance to have any hearing on Presidents Obama’s nominee was more political than principled.

With Donald Trump as their nominee, and the potential of having Hillary Clinton as president, the fear that her nominee this time and, with future retirements or deaths of other justices, her future nominees might be too progressive, it seems the GOP has decided it will continue to block Supreme Court nominees if not done by a member of their party.

Senator McCain has said, “I promise you that we will be united against any Supreme Court nominee that Hillary Clinton, if she were president, would put up.”

He wants to “ensure that there is not three places on the United States Supreme Court that will change this country for decades.”

He is proposing that only Republicans should be allowed to choose Supreme Court justices. If the Senate stays majority Republican, we can effectively go from now until 2020, or even to 2024 with 3 missing justices on the Supreme Court.

Instead of 9 justices there will only be 6 provided no one unexpectedly dies early.

How legitimate would reasonable people consider the Supreme Court and its rulings to be if the GOP refuses to consider the nominees of a legally elected president because she is not of their Party, but then quickly acts the moment the White House goes to them, if it does?
