The allowable land grab

grab

Remember the support that Clive Bundy got from conservatives because the government wanted him to pay rent for the public land he was using to make money?

It was all about the little American Guy standing up to the overreaching cruel government who wanted to ignore his rights as a land owner. Of course, it wasn’t his land, but that was irrelevant.

He was fighting for all those who worked the land. Well, not all of them, but acknowledging that sort of hurts the image.

He was us.

Recently, the Nebraska Supreme Court overturned a lower court that had ruled that the property rights of landowners who do not want the Keystone XL pipeline built on their land and fear that a spill could devastate the region’s drinking water and agriculture-based economy should not be violated, and the XL Pipeline should not cross their property.

But, even though the 7 judge panel had voted 4-3 to back the lower court’s ruling that such use of eminent domain would be unconstitutional, it wasn’t the super majority needed to uphold it.

Now the Canadian oil firm TransCanada is free to “seize property using eminent domain from any landowners who deny the developer access.”

This effectively allows a foreign company to take over land owned by American citizens.

Conservatives are thrilled that the president has no more excuses to delay the XL Pipeline.

They seem to have completely ignored that a foreign company now has power over American citizens, and support the move.

The GOP in the House and senate are thrilled that they can now authorize the building of the pipeline and pay back their debts to such people as the Koch brothers who financed their election campaigns, and be able make money off their investments in it as well.

Apparently the rights of American farmers and ranchers don’t count in this case, even though they do not want the pipeline to transport heavy crude from the Canadian tar sands across the Ogallala Aquifer, their source of clean water, especially as TransCanada has a poor safety record.

But when it comes to the property rights of law abiding citizens wanting to protect property they own and have paid for, as opposed someone wanting to make money off public land for free, and making money for themselves and the people who give them money, it’s clear where  politicians’ priorities lie.
